Abstract Population growth in the cities has imposed a search for alternatives to meet social desires for a better quality of life. This is a challenge for managers, as there are many aspects to be improved, from infrastructure to reduction of violence. The purpose of this article is to study a new city model, desired both nationally and internationally, called smart city. To reach this goal, the hypothetical-deductive method was used to analyze doctrine and legislation. The analysis of the subject contains three topics. The first is to highlight the environmental implications of urban growth; the second highlights the models of urban planning, among them the smart city, and then addresses the core of the study, which is the legal challenge that comes with the implementation of smart cities. This last aspect focuses on the violation of citizens' privacy and Brazilian legislation. The research concluded that smart cities have advantages and disadvantages and that Brazilian law has mechanisms to curb the violation of citizen's privacy. However, it is necessary to make the population aware of these new technologies being introduced, as well as their risks.
